Terms of Service
The terms that apply when you sign up for or use the Prelko forecasting platform. Where your organization has a signed agreement with us, that agreement takes precedence.
1. Acceptance
By creating a workspace or using the Prelko platform (the "Service") you agree to these terms on behalf of the organization you represent, and confirm you are authorized to do so.
2. The Service
The Service provides load and generation forecasts, peak-demand and deviation alerts, dispatch and balancing recommendations, and performance reports, based on data you provide or connect.
Features available to you depend on your plan (Starter, Growth or Utility), as described on the pricing page or in your order.
3. Forecasts and recommendations are advisory
Forecasts are probabilistic estimates and will contain error. Recommendations are suggestions for your qualified personnel to evaluate. The Service does not control grid infrastructure or execute dispatch actions.
You remain solely responsible for operational decisions, for the safe operation of your network, facility and equipment, and for compliance with grid codes, licence conditions and safety regulations. Approving a recommendation in the Service is a decision made by your personnel.
4. Accounts and access
- Login credentials are issued to the work email provided at signup. Keep them confidential and do not share accounts.
- You are responsible for assigning roles, including who may approve recommendations, and for removing access when people leave.
- Tell us promptly through the contact page if you suspect unauthorized access.
5. Your data
You retain all rights to the load, generation and operational data you provide and to the forecasts and reports produced from it. You grant us a limited licence to process that data solely to provide, secure and support the Service for you.
You may export your data at any time. On termination we will delete it on request, after giving you a reasonable opportunity to export it. Our handling of personal information is described in the Privacy Policy.
6. Acceptable use
- Do not attempt to access other customers' workspaces or probe, scan or disrupt the Service.
- Do not upload data you do not have the right to share, or consumer-identifiable data unless agreed in writing.
- Do not reverse engineer the Service or use it to build a competing product.
7. Fees
Fees for Growth and Utility plans are set out in your order or proposal. Unless stated otherwise, fees are billed in advance, are exclusive of applicable taxes, and are non-refundable for the current billing period.
8. Availability and changes
We aim to keep the Service available at all times and schedule maintenance outside typical peak hours where possible. We may improve or change features; we will not materially reduce the core functionality of your plan during a paid term.
9. Warranties and liability
The Service is provided with reasonable skill and care. Beyond that, and to the extent permitted by law, it is provided without warranties of any kind, including that forecasts will be accurate or that any peak will be detected.
To the extent permitted by law, we are not liable for indirect or consequential losses, including lost revenue, penalties, power purchase costs or equipment damage arising from operational decisions. Our total liability is limited to the fees you paid for the Service in the twelve months before the claim.
10. Termination
Either party may terminate at the end of a subscription term with notice as set out in your order. We may suspend access for serious breach of these terms, after notice where practical.
11. Governing law
These terms are governed by the laws of India, and the courts at Pune, Maharashtra have exclusive jurisdiction over any dispute arising from them.
